List Rental Terms & Conditions
These List Rental Terms and Conditions govern the rental of mailing lists and data from Peachtree Data, Inc. ("Peachtree Data"). They apply in addition to Peachtree Data's general Terms and Conditions; where the two conflict on a rental order, these terms control. "You" and "Your" refer to the party renting the list.
Please read first — lists are provided "AS IS"
Mailing lists are provided "AS IS." It is Your sole responsibility to confirm the list is correct and meets the criteria You requested before You use it. At a minimum, before mailing, check that:
- the final Count Report reflects the selection criteria You requested;
- the quantity matches what You ordered;
- the geography matches Your intended market area;
- there are no duplicate records, if duplicates were not requested.
These are recommended checks, not a comprehensive list. If anything looks wrong with the list You received, notify Peachtree Data immediately — before You mail — so we can review and resolve it quickly. A mistake caught before mailing costs nothing; one caught after can be expensive.
1. A rental is a license, not a sale
A list rental grants You a limited license to use the rented names one time, for a single mailing. You do not acquire ownership of the list, or any right to it beyond that one-time use, unless Your order expressly states otherwise.
2. Order approval
Most list orders do not require prior approval of Your mailing. Some lists — where the list owner or data source requires it — do. When approval is required for a particular list, Peachtree Data will tell You, and the names will not be released until You have submitted Your mail piece or offer and it has been approved.
3. Permitted use and restrictions
Rented names may be used only for the one mailing described on Your order. Unless Your order expressly says otherwise, You may not:
- use the names more than the one time licensed;
- copy, store, or retain the names after that mailing, or add any rented name to Your own database or house file;
- resell, trade, transfer, or disclose the names to any third party;
- use the names for any channel or purpose other than the approved postal mailing (list rentals are for postal mail only).
4. Responders are yours; the rest are not
Individuals who respond to Your mailing become Your customers, and You may keep and use their information freely. The restrictions above apply only to names that do not respond.
5. How names are delivered
At Your choice, Peachtree Data will deliver the rented names either to You for Your one-time mailing, or directly to Your mail house or letter shop. Either way, the one-time-use and no-retention terms above apply to everyone who handles the list on Your behalf.
6. Decoy names
Rented lists contain decoy (seed) names that Peachtree Data monitors to detect unauthorized use. Their presence and monitoring are disclosed here and are the basis for enforcing the use restrictions in Section 3.
7. How our lists are sourced and maintained
Peachtree Data is not a list compiler. We leverage the most reliable consumer and business list compilers in the industry, and the data we deliver is pulled to industry-standard address quality — ZIP+4 coded and DPV® confirmed, and kept current with regular NCOALink® updating. All major compilers use similar data-hygiene methods, and any list Peachtree Data delivers will meet these standards.
8. No warranty on list accuracy
Because lists are provided "AS IS," and except as expressly stated in the general Terms and Conditions, Peachtree Data makes no warranty that any name or address on a rented list is current, accurate, deliverable, or fit for a particular purpose, and all such warranties are disclaimed.
9. Limitation of liability
Consistent with standard mailing-list industry practice and the general Terms and Conditions, Peachtree Data's total liability arising from a list rental — including for any inaccuracy in the list — is limited to the amount You paid Peachtree Data for that rental. Peachtree Data is not responsible for printing, production, mailing, or postage costs, or for any indirect, incidental, or consequential damages. The list business is built as a self-serve model: the margin on list data is small next to the cost of printing and postage, so — as with every list provider — Peachtree Data cannot assume liability beyond the cost of the list itself.
10. Payment
Rentals are billed per thousand names, subject to a minimum order, and are due under the payment terms of the general Terms and Conditions (net terms; 1.5% per month late charge) unless Your order states otherwise. List rentals are billed on the ordered quantity; net-name credits do not apply.
11. Cancellation
Once an order is placed, it cannot be cancelled — whether or not the list has already been delivered. If You need to cancel, contact Peachtree Data as soon as possible and we will make our best effort to stop the order. We cannot, however, guarantee that a placed order can be cancelled, and if it cannot be, the order is payable in full.
12. Data handling and retention
The list and Your order data are Confidential Information under the general Terms and Conditions. Peachtree Data does not retain rental order files: once Your list has been securely delivered, the order data is deleted from our systems. This data-minimization practice supports consumer privacy and compliance with applicable state privacy laws. After delivery, responsibility for the storage, use, and regulatory compliance of the list rests with You.
13. Lists sourced from third-party data providers
Because our rented data originates with third-party compilers (see Section 7), those suppliers' own use restrictions apply to it. By renting such data, You agree to those restrictions, which Peachtree Data will make known to You where they are more restrictive than these terms.
14. Your responsibilities and indemnity
You are responsible for ensuring Your mailing and offer comply with all applicable laws, and You indemnify Peachtree Data against claims arising from Your use of the rented names.
15. Governing law
Georgia law governs; venue is Gwinnett County, Georgia.
Frequently asked questions
If a Peachtree Data representative delivers the list, does that make Peachtree Data responsible for its accuracy?
No. A representative's help in selecting and pulling the best list to meet Your stated requirements is expertise and convenience — it does not transfer to Peachtree Data the responsibility for verifying the delivered list.
What if I can't tell whether the delivered list is correct?
If the count report, quantity, and geography match Your order, the list was very likely pulled correctly. If You have any doubt, contact Your representative immediately so the order file can be double-checked before You mail.
Do errors happen often?
No — they're rare. But if a mistake isn't caught before mailing, the financial impact can be significant, which is why the checks above matter.
Why doesn't Peachtree Data take responsibility for the whole mailing?
This is standard across the list industry. Providers are responsible only up to the cost of the list. The margin on list data is small next to the cost of printing, mailing, and postage, so it isn't practical for any list provider to take on the liability of an entire campaign.
